JEWEL ROYAL SAGA – TERMS OF SERVICE

The following Terms of Use (“Terms”) govern your use of Jewel Royal Saga (“the App”) provided by Fyber Monetization Ltd. d/b/a “Digital Turbine” (“DT”). The App is available in the Google Play app store, and these Terms apply to all content, features, and services available within the App. By downloading, accessing, or using the App, you acknowledge and agree that you have read and understood these Terms and accept them in their entirety. If you do not accept these Terms in their entirety, then you may not access or otherwise use the App.

1. Usage of the App:

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your mobile device solely for your personal, non-commercial purposes.

2. Restrictions:

  • You may not: (i) copy, modify, distribute, sell, or lease any part of the App; (ii) reverse engineer or attempt to extract the source code of the App; (iii) remove any copyright, trademark, or other proprietary rights notices from the App or any content therein; (iv) use the App for any illegal or unauthorized purpose; (v) interfere with or disrupt the operation of the App or servers or networks connected to the App; (vi) use any data mining, robots, or similar data gathering or extraction methods; (vii) access the App through any means other than the interface provided by us.
  • You agree to comply with all applicable laws and regulations regarding your use of the App.

3. Fonts License:

  • You acknowledge that the App may utilize fonts (“Fonts”) to display content. Your use of the Fonts is subject to the terms and conditions of the applicable font licenses.
  • The Font ‘Boyz R Gross NF’ may be downloaded and used free of charge for both personal and commercial use, as long as the usage is not racist or illegal. The applicable font license is available at https://blogfonts.com/boyz-r-gross-nf-2.font.
  • The use of the Font ‘Poetsen One’ is subject to a license and copyright notice. The Font Software is licensed under the SIL Open Font License, Version 1.1 and is available at SIL OFL 1.1.
  • The Font is owned by Pablo Impallari and Rodrigo Fuenzalida and protected by the following copyright: Copyright (c) 2012, Pablo Impallari (www.impallari.com|impallari@gmail.com) and Rodrigo Fuenzalida (www.rfuenzalida.com), with Reserved Font Name Poetsen.

4. Intellectual Property:

The App and all content, features, and functionality within the App are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

  1. Privacy:
  • Your use of the App is subject to our Privacy Policy, which governs the collection, use, and disclosure of your personal information. Our Privacy Policy (available at https://www.digitalturbine.com/notice-at-collection-and-privacy-policy-for-jewel-royal-saga/) contains information about DT’s data protection policies and explains how DT accesses, collects, uses and/or shares information that is generated by your use of the App. You consent to DT’s use of your data in accordance with DT’s Privacy Policy.
  • DT prohibits the violation of a user’s privacy rights. If you believe that your legal or privacy rights have been violated while using the App, please contact us at privacy@digitalturbine.com.

6. Disclaimer of Warranties:

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability:

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

8. Governing Law:

These Terms shall be governed by and interpreted under the laws of the State of Israel, without reference to its conflicts of laws provisions. All claims arising out of or relating to these Terms will be litigated exclusively in the competent courts of Tel Aviv, Israel.

9. Changes to Terms:

We reserve the right to modify or replace these Terms at any time. Any changes will be effective immediately upon posting the revised Terms within the App. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
